On January 24, 2011 I sent you an e-mail message outlining how I was going to restructure both your contract payment and appointment schedule for Third Party Testing. This e-mail stated specifically how the contract payment for providing an examination for an individual’s Third Party Test would be reduced effective on February 1, 2011 and another reduction effective April 1, 2011. In addition to this I stated I was going to restructure the road testing times from 1 ˝ hours to 1 hour.
I received a letter from you on Saturday, January 29, 2011 that stated, “Tom and I have concluded our conference regarding your proposal. We do not accept it”. Based on this information and the fact that my e-mail was not a proposal, I am left no option but to treat your response as a termination of your contract as a Road Test Examiner for Lakeshore Precision Drivers Training, LLC, the Third Party Testing Organization.
I understand this and will consider this your termination of your contract to provide examination services for Lakeshore Precision Drivers Training, LLC, effective Tuesday, February 1, 2011. I will also be contacting the State of Michigan, Third Party Testing Section, to advise them that you have terminated your contract to provide Road Testing Examiner services with Lakeshore Precision Drivers Training, LLC.
I am sorry you feel this way and wish you the best in your future endeavors. I need you to return all unused Road Test Certificates, score sheets, traffic cones, and any other materials or property of Lakeshore Precision Drivers Training, LLC by Friday, February 4, 2011. You will also need to remove your storage container from the Robbins Rd. test site by this same date or I will consider it abandoned and remove it accordingly. Your final contract payment will be issued upon receipt of all materials listed above.
